That's a tiny subset of the real problem of the GPL. Consider that it
also prevents you from having zfs in the Linux kernel, zfs being neither
proprietary nor distributed only in binary. And that's just the obvious
thing you might know about and want today. The number of possible
combinations of things it prevents from being distributed are actually
astronomical.

you can run ZFS AND not have to deal with messy GPL kernel...it's called
Open Solaris
Which can't use device drivers that have GPL restrictions - the viral
nature of the GPL has hijacked much of the work that would otherwise be
available for any use.
