I'm sure you're not poking fun at Linux because the maintainers are unwilling to break the law, are you?
But feel free to poke fun at them because they won't cooperate with anyone who wants to give their software away in a different manner (ati, nvidia, vmware...), and for making it next to impossible for anyone to supply copies of things that don't break the law as part of the distribution even to people willing to pay for them.

The sarcasm of previous posters (not Les) notwithstanding...

Companies are free to have their device drivers written for them under
NDA if they choose...

I'm not sure how much strength remains in ATI/Nvidia/etc. arguments.

It's the fact that there is an argument instead of cooperation that makes it problematic for the user, not the strength of either side...

Anyway, I guess it would be fun to see how they propose to release source without disclosing how it works - or whatever the NDA covers.
