Jose Padilla. Though he wasn't sent to Gitmo, he was just held without formal charges being filed for several years while being tortured. Eventually he was charged with different crimes than what the government had previously said they could charge him with. At least his case finally got into the court system. (The Bush administration wanted to avoid a definitive ruling in his case and agreed to transfer him when it looked like they might lose.)
