If your in the UK they may cut you off straight away this is to protect them not you! as BT (and BT House in London) monitor bandwidth usage primarily so they can screw extra money but more importantly they have the power to cut an ISP off so any ISP will do the usual 'strike first ask questions later' in your case I think you'll find even though you are an innocent victim they will ask you to take the domain name down so that spammers will be driven off the net.
