The patent regulation proposal was rejected wholesale, but better would have been for the proposal to be adopted with specific provisions against software patents. Problem is that under EU rules the european parliament is an afterthought attached to a trading cartel. The parliamant has no legal method that I know of for proposing legislation, they can only ammend what the commision sends them to debate.
