For a description pf the problem refer to http://www.linuxquestions.org/questions/showthread.php?s=&threadid=334109 After reading a little bit further, the labels are a feature of ext3 file systems, so this problem would occure when ever a non ext3 filesystem would be in the partition table before the root file system.
