If we tamper with the linux-$version.tar tarball, the md5's/.signs from upstream would differ, which would break the current build process. If we added a patch to remove fs/ntfs, that patch would get distributed with the kernel .src.rpm I imagine our legal folks have already done the legwork on this one, and come to the conclusion that shipping the source isn't a problem, whereas shipping a binary is.
