I've just greped and I found :
if (!retval && test_bit(TTY_EXCLUSIVE, &tty->flags) && !capable(CAP_SYS_ADMIN))
retval = -EBUSY;
in drivers/char/tty_io.c:tty_open
Which sources are you looking at?
