Its pretty clear in europe and fairly clear in the USA, under exactly the
same laws that deal with web proxies and with ftp mirrors, all of which
could also be carrying content in violation of a licence somewhere.

Over here an ISP for most actions is defined as a "mere conduit" for data.

No idea about .au, but then thats a country with a lot of more serious
legal issues
