due course to a court and proof they are guilty. Its this two tier form
of democracy that the Arab states are so suspicious of.

Actually part of the Geneva Convention. If a combatant is not in uniform, they are not given the same rights as an enemy soldier. I have read it when the whole discussion about the rights of enemy combatants and enemy soldiers came up years ago.
